Overview

Patrick McShane’s primary expertise is in environmental and energy law, regulation, and policy with a focus on environmental regulatory and transactional matters. His specific work experience involves compliance with federal and state laws and regulations, wastewater and drinking water permitting, solid and hazardous waste matters, and enforcing environmental ordinances. Patrick also has experience providing legal support for implementing sustainability and renewable energy projects and for redeveloping Brownfield sites.

In addition to environmental and energy law, Patrick’s experience includes advising on transactional matters, including government procurement and contracting, professional service contracts, infrastructure construction projects, real estate, and multiple areas of municipal law, including public finance and tax, intergovernmental relationships, and state and municipal legislation.

Patrick previously worked as a contract attorney for the firm where he advised on environmental and energy law and regulation with a focus on transactional matters. Prior to joining the firm, Patrick worked in Savannah, Georgia as a Contract Specialist at a national construction consulting firm retained by the Georgia Department of Transportation to implement their multi-billion-dollar Major Mobility Investment Program.

Patrick also brings a unique perspective to his practice having worked in the public sector for more than ten years as Senior Assistant City Attorney for the City of Atlanta Legal Department, Policy Director for the City of Atlanta Department of Watershed Management, and Legislative and Regulatory Analyst at Southern States Energy Board.

Reviewed multiple agreements for a renewable natural gas facility to be constructed in California.

Prepared project finance documents for solar farms to be built in North Carolina.

Revised equipment purchase and services agreements for a solar powered battery storage facility.

Negotiate feedstock and offtake agreements and project finance documents on behalf of multiple clients engaged in manufacturing sustainable aviation fuel and other renewable fuels.

Assisted client secure private project financing to develop project to turn livestock waste into a renewable natural gas.

Advised multiple clients on process to secure public financing for various renewable energy projects.

Negotiate various documents, including a letter of intent and ground lease agreement, on behalf of clients developing lithium-ion battery manufacturing facilities.

Assisted a client conduct due diligence before investing in a crypto mining facility, including advising on implementing a power purchase agreement.

*Advised on compliance with consent decrees with the Environmental Protection Agency for a municipal combined sewer system and separate sewer system.

*Negotiated audit agreements and performance contracts for a Guaranteed Energy Savings Performance Program to help reduce overall water and energy use for municipal buildings.

*Advised on compliance with Title V air permits for municipal wastewater treatment plants and airport facilities.

*Implemented a Property Assessed Clean Energy program for commercial and residential properties.

*Drafted and negotiated a Solar Energy Procurement Agreement on behalf of a municipality that allowed for the financing and installation of solar panels on municipal buildings.

*Advised on the Georgia Hazardous Site Response Act, the Georgia Voluntary Remediation Program Act, and the Georgia Brownfields Act for property acquisition and development.
