Chelsea Simon focuses her practice on complex commercial litigation. She represents industrial, engineering, commercial, energy, and construction businesses on a wide variety of issues including commercial contract disputes and business torts; construction law and bond law; financial services litigation; and first amendment, media, and broadcast law.

Prior to joining the firm, Chelsea was an associate in the Commercial Litigation Practice and Construction Industry Groups at a national law firm in its Charleston, West Virginia office where she primarily focused on banking and finance, commercial, and construction litigation.

While attending Washington and Lee University School of Law, Chelsea served as a judicial intern for the Honorable Anthony J. Trenga in the U.S. District Court for the Eastern District of Virginia. Chelsea was also Editor-in-Chief of the Journal of Civil Rights and Social Justice.

While attending Davidson College, Chelsea served as a judicial intern for the Honorable William J. Condon in the New York State Supreme Court. She studied history abroad at the University of Cambridge in Cambridge, England and at Trinity College Dublin in Dublin, Ireland during the summer and fall of 2011.

Experience

Wireless World LLC d/b/a Experts Choice v. T-Mobile USA, Inc. and Sprint Solutions, LLC, King County, Washington, Case No. 23-2-16531-4-SEA. Served on trial practice and complex motions team that won and obtained confirmation of a $13,950,060 arbitration award, including damages, attorneys’ fees and costs, on behalf of a small business wireless retailer client in JAMS arbitration. Following the merger between T-Mobile and Sprint, we represented Wireless World, former Sprint cellular phone and mobile services retailer that transitioned to T-Mobile post-merger. After Wireless World sold its business for a significantly reduced value because of alleged deceptive actions by T-Mobile and Sprint, we filed an arbitration with JAMS. Following a one-week hearing, retired Washington Supreme Court Justice Faith Ireland entered a final award in our client’s favor, finding violations of Washington’s Consumer Protection Act (a state unfair and deceptive trade practices or “mini-FTC” Act). A Washington Superior Court judge confirmed the award over T-Mobile’s motion to vacate.

*Successfully litigated a multi-million dollar construction lawsuit on behalf of a state municipal utility

*Defended against a $1.25 million suit during a two-week trial involving highly disputed construction litigation and achieved a highly favorable settlement afterward during post-trial briefing

*Briefed post-trial appeals before the Supreme Court of Appeals of West Virginia
