Kilpatrick attorneys routinely and ably advise clients on maintaining compliance with the ever-changing body of state and federal occupational health and safety laws. Our team regularly updates clients on key workplace and safety developments in their industries. They also assist with drafting standard operating procedures, policies, and practices to comply with various areas of regulation, including record keeping and reporting, hazard communications programs, prevention of hearing loss, and the increasing concerns about ergonomics and cumulative trauma disorders. In the area of workplace violence, we assist in the development of policies to address the issue, facilitate effective detection, and bring a swift end to hazardous situations.
Approach
Respond & Defend
We provide counsel and guidance to clients throughout the on-site investigation process. Our attorneys also prepare clients for informal proceedings, where they seek to reduce penalties and negotiate downgrades of citation categories. We support clients in combatting the recent rise in employee whistleblower and retaliation claims through drafting OSHA compliant anti-retaliation policies, effectively documenting investigations of employee complaints and performance issues, and responding in a timely fashion to OSHA requests for employer position statements and related documentation. Kilpatrick attorneys have successfully challenged citations under both federal and state laws and have achieved positive results in litigation in toxic torts, environmental claims, and other areas related to employee safety and health standards.
