Perils and Pitfalls: The Intersection of North Carolina Law and Construction Contracting

Kilpatrick attorneys Dustin Greene, Mark Boynton, and Chelsea Simon will provide information and practice pointers that in-house counsel, outside counsel, and construction clients without in-house counsel can utilize when drafting and analyzing construction project contracts. While there will be a brief discussion on public projects and standard contract forms, this seminar is focused on the intersection of North Carolina law and private construction projects and contracts, including the interpretation and enforceability of key contract provisions under North Carolina law. 

The seminar will also include a brief overview of North Carolina’s licensing requirements and issues pertaining to privity and flow down clauses, dispute resolution, choice of law, forum selection clauses, attorneys’ fee clauses, and liquidated damages provisions. The presenters will review significant North Carolina cases to provide attendees with a better understanding of how courts interpret and enforce construction contracts and handle issues that may typically arise on construction projects in North Carolina.
