Brian Corgan concentrates his practice exclusively in construction contracts, litigation, and alternative disputes resolution. Mr. Corgan has handled and litigated construction disputes involving LNG plants, chemical and petrochemical production facilities, nuclear and coal-fired power plants, cement plants, heat recovery steam generators (HRSG), hydrogen plants, international airport runway construction, prisons and correctional facilities, cogeneration (power, cement, and lime) plants, off-shore oil production, storage and off-loading facilities, wastewater treatment plants, environmental remediation and closure projects, mining facilities, meat processing facilities, steel mills, oil refineries, hospitals, convention centers, and a variety of other heavy industrial construction projects.
Since 1979, Mr. Corgan's practice has focused exclusively on the representation of EPC contractors, heavy industrial contractors and subcontractors, construction managers, and owners on heavy chemical, petrochemical, industrial, power, and infrastructure projects. He has been involved in ICC, ICDR, AAA, and self-administered arbitrations, mediations, and state and federal court trials.
Mr. Corgan's practice is focused on large mega-projects such as the design and construction of:
- A massive mono-ethylene glycol plant;
- Various coal-fired power plants;
- Numerous LNG Liquefaction projects;
- Combined cycle energy facilities;
- A tetrafluoropropene plant;
- The installation of numerous Texas Module Projects;
- A steam methane reformer hydrogen plant;
- Four grassroots 1,000 MW nuclear power plants;
- Heat Recovery Steam Generator (HRSG) projects;
- A massive copper mining and electrowinning facility;
- A $2.4 billion multi-EPC off-shore oil production, storage, and off-loading facility in the South China Sea;
- A large cement/power/lime cogeneration facility;
- Large cement plants;
- Large multi-use convention centers;
- Chemical and petrochemical facilities;
- Oil refineries and related expansions;
- Large, complex aquariums; and
- Numerous design-build and EPC projects including beef processing facilities, cogeneration and power plants, prisons and correctional facilities, military defense projects, research facilities, and environmental remediation and closure projects.
Mr. Corgan is a Fellow of The American College of Construction Lawyers. He was recognized in 2009, 2011, 2012, 2014, 2015, 2016, 2017, 2018, 2019, 2020, 2021, 2022, 2023 and 2024 by the prestigious Legal 500 US in the field of Construction Law, recognized repeatedly for Construction in The International Who's Who of Business Lawyers, and Corporate Counsel's Top Lawyers for 2011. He was also honored in 2014, 2015, 2016, 2017, 2018 and 2019 as a "Leading Lawyer" and in 2020, 2021, 2022, 2023 and 2024, he was named to its “Hall of Fame” by Legal 500 US for Construction Law. Experience
Conducted a three-week arbitration for one of the largest heavy industrial contractors in the United States involving the design and construction of a mono-ethylene glycol plant in Texas. The client suffered design delays and changes, delays in mega-module and various equipment deliveries, massive scope changes, and disruptions by the EPC Contractor, an international joint venture. Obtained an Award of over $40 million in the ICDR arbitration, with interest and attorneys’ fees. The entirety of the counterclaims submitted by the EPC Contractor were rejected.
Represented a prominent heavy industrial contractor in a four-week arbitration involving the construction of a heat recovery steam generator (HRSG) in the Gulf Coast. The disputes involved pricing disputes over scope changes, delays and disruptions, and lost productivity in an ICDR arbitration. The dispute also entailed multiple state and federal court actions filed by the project owner designed to avoid and delay the arbitration. Our client was awarded $26.3 million, including 100% of its damages, interest, and attorneys’ fees. The counterclaims of the Owner were denied in their entirety.
Represented an international oil, gas, and chemical EPC contractor in a dispute over pricing of scope changes and delays to its construction of a LNG facility in the Northeast. We were able to resolve the dispute through a year-long mediation and binding dispute resolution process, successfully converting a lump sum contract to fully cost-reimbursable.
Represented an EPC contractor, which was a tri-venture comprised of three international design and construction firms, in litigation in Kansas state court concerning the design and construction of a coal-fired boiler for a new power plant in Texas. Millions of dollars in claims against the designer/manufacturer of the coal-fired boiler were successfully resolved by payment to our client of a mid-eight figure USD amount.
Successfully obtained award in favor of a joint venture partner of an EPC contractor by summary judgment in ICDR arbitration on a Dominion LNG plant.
Represented a prominent heavy industrial contractor in a four-week ICDR arbitration arising out of the construction of a hydrogen plant in Texas for an international producer of industrial and medical gases. Our client suffered millions of dollars in damages due to scope changes, delays, and disruptions caused by the owner, combined with repeated acceleration directives. Because of the multitude of changes, over 1,000 Requests for Information were issued on this project, as well as almost 800 Requests for Change Orders, totaling 40% of the contract value. The Panel awarded our client more than 90% of its claimed damages, interest, and attorneys’ fees.
Defended a large general contractor sued by the Owner for fraud, conspiracy, and defective construction of a large project in North Carolina. The Owner filed over $80 million in claims against our client. We conducted a four-week arbitration, defeated all of the Owner’s claims, and were awarded our 100% of our client’s attorneys’ fees and costs and expenses of the arbitration.
Represented a multi-national contractor in an ICC multi-week arbitration involving the design and construction of a large missile defense system in Poland. The ICC arbitration was conducted in Frankfurt, Germany.
Represented a large Texas EPC contractor on disputes related to Freeport, Texas LNG Project (Trains 1&2).
Represented a large heavy industrial contractor against EPC contractor on Salem Harbor Energy Center 674 MW Natural Gas Combined Cycle Facility.
Lead counsel for Westinghouse LLC, the EPC contractor responsible for the design, construction, and commissioning of four new 1,000 MW nuclear units. The project is budgeted at in excess of $27.5 billion in construction costs. Mr. Corgan and his team sued the four public owners of the project in federal court, seeking $1.6 billion in damages, the largest piece of construction litigation pending in the United States at that time. Mr. Corgan worked extensively with the client’s in-house staff of five lawyers and we provided and regularly updated budgets, schedules, and metrics dashboards. Mr. Corgan’s team managed the collection of more than 8.9 million documents across 60 document custodians. Mr. Corgan and his team prepared for, took, and defended more than 100 interviews and expert and fact depositions.
Represented a worldwide oil and gas organization with respect to disputes against various EPC contractors retained to perform the design, construction, and commissioning of an off-shore oil production, storage, and off-loading facility located in the South China Sea, off the coast of Malaysia. The project cost is in excess of $2 billion. We have been involved in formal dispute resolution processes in Malaysia and have negotiated other claims with various EPC contractors throughout Europe. In addition, we have asserted claims by our client against various of its EPC contractors, most contracts which include limitation of liability provisions tied to a specified percentage of the EPC contract price.
Represented a remediation contractor terminated by EPC contractor on solid waste storage area cleanup project. After a three-week federal court trial, recovered $9.8 million in damages, plus interest and attorneys’ fees. Defeated EPC contractor’s claim in its entirety.
Represented heavy industrial contractor against owner on Tetrafluoropropene production plant, resulting in 100% recovery of claimed amount.
Obtained a jury verdict for $7 million, plus attorneys’ fees, and defeated a $10 million counterclaim in its entirety after a seven-week federal court jury trial in San Francisco involving the design and construction of a large cement plant.
Recovered $9.8 million on claims of $10.3 million, plus attorneys’ fees, interest, costs, and expenses after 36-hearing day arbitration involving the construction of a coal fired power plant in Council Bluffs, Iowa. Also defeated counterclaims totaling $55 million in their entirety. Award was issued on August 6, 2009, and confirmed by the United States District Court for the Southern District of Iowa on November 23, 2009. The case involved the production of more than 3,000,000 electronic documents, and required their review, organization, and utilization for depositions and the arbitration hearings.
Represented a pipeline construction contractor against an owner and recovered a $5.8 million jury verdict following a 12-day trial in the United States District Court for the Western District of Pennsylvania. We also sought, and were awarded, a substantial monetary penalty under the Pennsylvania Contractor and Subcontract Payment Act (CASPA) as well as interest and attorneys’ fees and expenses, bringing the judgment to over $13 million. The owner took an appeal which we also handled for the client. The Third Circuit Court of Appeals affirmed the judgment in its entirety, which grew to over $15.5 million while the case was pending on appeal and was ultimately paid to our client.
