Served as lead defense counsel for national insurance agency and subsidiary of Truist Bank in a federal court action in Arkansas against negligent insurance procurement claims between corporate plaintiff and defendant insurance broker related to property damage claim at largest hotel in Knoxville, Tennessee. Plaintiff alleged that due to the parties’ special relationship, the failure to obtain appropriate insurance coverage for a renovation of the hotel led to the failure of the renovation project and ultimate foreclosure on the hotel that had wide-ranging damages in excess of $17M. After contentious discovery including dozens of fact and expert depositions, the Court granted defendant’s motion for summary judgment in full, finding no special relationship existed between the parties. Christin then argued and obtained full affirmance of the judgment before the Eighth Circuit. This was an especially meaningful outcome for the client, as the industry sees this “special relationship” argument often, and the Eighth Circuit’s opinion clarified the scope of an insurance broker’s duty to its clients under the applicable law.
