Proper Risk Allocation: Disarm Disputes Before they Arise
This session will highlight the importance of obtaining an understanding of risks during the project inception and contract negotiation, properly allocating who bears those risks and then ensuring there are mechanisms in place in which to help manage the risk. Experience shows that disputes are most likely to occur when there is an inappropriate allocation of risk in the contracting phase, or the parties behave in a way that does not align with the risk allocation in the contract.
