Kilpatrick 2026 “SKI”-LE®

In October 2025, the USPTO implemented a new pilot program to streamline and expedite the prosecution of original utility applications. The Director of the USPTO issued a memorandum in December 2025 indicating that expert declarations under 37 C.F.R. § 1.132 may be submitted to address subject matter eligibility rejections under 35 U.S.C. § 101.
