Denver Managing Partner Justin Krieger was recently quoted in Law360 on the recent trend of America Invents Act reviews being denied due to inconsistent claim construction positions, emphasizing the need for strategic alignment across all forums.
In most cases, Justin said he "would advise clients to make sure you're sticking with the same claim construction argument you raised in district court, and if you're deviating at all, you better have a pretty good reason for it and fully explain it."
