This session will provide an overview of recent developments in post-grant proceedings before the U.S. Patent Trial and Appeal Board (PTAB) and the effect of these developments on PTAB strategy as well as in parallel district court proceedings. Our discussion will include coverage of 1) the recent Fintiv case and its aftermath and its impact on strategy for filing and dealing with estoppel, 2) the recent Thryv decision from the U.S. Supreme Court addressing the appealability of the one-year time bar and its broader ramifications on PTAB strategy, and 3) evidentiary issues that arise, particularly in the context of Section 101 arguments in PGR proceedings.
