Thomas Holt represents companies ranging from emerging brands to global market leaders, helping them protect, enforce, and commercialize their most valuable intellectual property assets. With nearly three decades of experience, Tom represents clients in high-stakes trademark, trade dress, copyright, and false advertising matters, combining deep technical expertise with practical, business-driven judgment.

Tom has a strong track record of delivering successful outcomes for both plaintiffs and defendants, whether through trial, decisive pretrial motion practice, or efficient early resolutions outside of court. He is widely regarded for his ability to design and execute strategic brand enforcement and defense programs that align legal risk with commercial objectives.

Tom's practice spans complex federal court litigation and administrative proceedings, including actions involving ex parte seizures, temporary restraining orders, preliminary injunctions, and trial and appellate advocacy. He regularly represents clients before the Trademark Trial and Appeal Board in inter partes proceedings and in disputes involving internet and domain-name enforcement.

In addition to litigation, Tom counsels clients on U.S. and international trademark portfolio strategy, clearance, enforcement, and lifecycle management. He has significant experience drafting and negotiating intellectual property and brand-related agreements and is frequently called upon to advise on enforcement strategies that balance speed, cost, and long-term brand equity.

Prior to joining the firm, Tom was a partner in the Chicago and New York offices of an international law firm, where he served as firmwide chair of its nationally recognized Trademark, Copyright, Internet, and Advertising practice.

*Secured a significant legal victory in a trademark infringement action for a dark web threat intelligence and darknet data provider in a bench trial where the judge found no infringement between its mark and the competitor’s trademarks. U.S. District Court for the District of Colorado

*Represented a warehousing and self-storage business in various oppositions and a court action relating to its use and registration of a mark against infringement claims based on the client’s mark, both used in connection with self-storage services. After a years-long battle, secured a win for the client in its trademark dispute with rival self-storage company. In October 2022, the judge granted summary judgment of no likelihood of confusion to the client after finding that the two marks were dissimilar and that the rival self-storage company’s mark was conceptually and commercially weak, concluding that it was lacking public recognition and was descriptive rather than suggestive. *Represented a designer and manufacturer of laboratory instruments in a trademark opposition and district court trademark infringement action against an engineering and automation solutions provider.
