The old saying “nothing ever quite goes as planned” is an understatement when it comes to consent decree implementation. From reporting and monitoring requirements to unanticipated construction delays, and from economic recessions to substantial changes in community affordability, the list of potential challenges utilities face in complying with enforcement orders is daunting. And while many clean water agencies may seek modification of a decree when circumstances change unexpectedly, the process for pursuing modification can be difficult. Luckily, the veteran clean water professionals on this panel will provide helpful suggestions on how best to address the many challenges of consent decree implementation, as well as how to best secure effective modification of an enforcement order when necessary.
