Maryland, Virginia, and the District of Columbia do not require the payment of severance or transition pay by law; however, it often makes sense for employers to provide it in connection with certain employment terminations. Deciding whether to provide severance/transition pay is often not as difficult as determining how to design and implement the appropriate plan, policy, or agreement. This panel will discuss the common severance/transition pay arrangements (e.g. employment agreements (with severance provisions), separation and release agreements, and severance pay plans) and provide practical advice on how to structure severance arrangements that satisfy employers’ needs, reduce risk, all while complying with federal and state law, including ERISA, 409A, and the ADEA.
