While federal litigation remains a powerful tool to enforce IP rights, certain challenges in bringing and maintaining federal court actions have encouraged IP holders to look to other venues. The International Trade Commission (ITCT) provides certain advantages over district court litigation, provided that additional requirements are met. In addition, European venues such as Germany and Ireland are gaining prominence as fora to enforce IP rights. This presentation will discuss the state of patent litigation in U.S. federal courts, the requirements and advantages of ITC actions, and the basics of patent litigation in Germany and Ireland.
