Insights: Events An Overview of Section 337 Investigations at the U.S. International Trade Commission

ITC Trial Lawyers Association and the IP Law Section of the State Bar of Georgia CLE Program

This program, organized by the ITC Trial Lawyers Association and the IP Law Section of the State Bar of Georgia, will introduce Section 337 and discuss developments in and finer points of Section 337 law and procedure. Steve Borgman is moderator of a panel titled “Exploring the Overlap and Contrast Between District Court and the ITC” that will address the overlap and differences between a Section 337 investigation at the ITC and a patent case in federal court. Among other things, this panel will discuss the differences and overlap in procedures, discovery, and the hearing versus the trial, as well as the remedies available from the ITC and from federal courts, and how those might work to your client's advantage or disadvantage. In addition, this panel will discuss the interplay between a Section 337 investigation and a federal court action such as stays, transfer of record and res judicata issues.
