Evan Nadel is a member and presenter on this panel. Some courts are exploring a unique procedure to handle complex expert testimony. Referred to as an “Expert Hot Tub Hearing,” or concurrent expert evidence hearing, this process involves two or more opposing expert witnesses fielding questions from the judge and engaging with one another on comparisons of their expert opinions, including areas of agreement and disagreement on methodology, data, or conclusions. While fairly new in the U.S., the concept has been routinely used in other countries and is gaining popularity here. The practice is being implemented in connection with Daubert motions. Litigators should consider whether a hot tub hearing may be effective in their cases and be prepared to work with their experts to get them ready if one is ordered.
