  • Enforcement Trends in Criminal and Civil Trade Secret Law: This presentation by a former federal prosecutor provides an in-depth analysis of the complexities and nuances in recent trade secret enforcement by both the Department of Justice and private plaintiffs. It covers key aspects of developing criminal and civil law, such as the surprisingly flexible standards for identifying trade secrets, various criminal and civil enforcement mechanisms, and common challenges faced in prosecutions and litigation. The presentation includes discussions of key federal statutes -- the Economic Espionage Act and the Defend Trade Secrets Act of 2016 -- and case studies demonstrating how these laws are being used.
