"State tax agencies' hiring of former IRS workers is "a mixed bag for taxpayers," David Hughes, a tax partner at Kilpatrick, told Law360. Higher staffing levels can lead to quicker resolutions of examinations or administrative protests, he said.
Hughes added that hires who may have experience with federal transfer pricing issues can bring knowledge to state agencies that traditionally haven't had many in-house transfer pricing experts.
"Generally speaking, a state auditor is going to be way behind a federal auditor who has been trained in transfer pricing," Hughes said. "This is an opportunity for states to maybe shorten that gap a little bit between the taxpayer's expertise versus the state's expertise."
