The practice of law is an exercise in problem solving. Sometimes the problems involve difficult personalities, strong emotions, or unreasonable demands. When clients tasked him with resolving problematic consumer cases, including class actions, at the height of the financial services crisis, the presenter studied social and behavioral science literature for insights on how to overcome the obstacles presented by offended consumers, overly aggressive opposing counsel, and skeptical judges in challenging jurisdictions. He incorporated what he learned into his larger litigation practice and helped clients obtain desired outcomes, both inside and outside of the litigation context. The purpose of this CLE is to share his research and insights with our clients and guests so that they can improve their negotiation strategies.
