Prathyusha Chenji hosted and moderated a CLE titled “History Repeating: The Legislative Impact of Alien Land Laws in the U.S.” Alien Land Laws are legislation designed to bar non-citizen and non-permanent resident individuals from being able to purchase real property in the United States.
During this insightful discussion with legal scholars from around the country, the panelists explored the important history of alien land laws from the context of Oyama v. California (1948), and how they continue to emerge in present legislation (e.g. Florida’s discriminatory property law SB 264), as well as a case study of Shen v. Simpson (N.D. Fla) litigation at the district court and the 11th Circuit Court of Appeals.
The panelists were contributors to the Amici Curiae brief filed by racial justice centers, affinity bar and professional associations, and civil rights advocacy organizations. The brief highlights the historical use of alien land laws as a mechanism for anti-Asian racism and exclusion.
