Overview

Justin Krieger is Managing Partner of Kilpatrick’s Denver office and is a leading patent strategist with more than 25 years of experience guiding clients through complicated intellectual property challenges. Known for his ability to distill scientifically intricate issues into clear, actionable strategies, Justin is highly sought after for conducting freedom-to-operate (FTO) analyses in the chemistry, biochemistry, oil and gas, mechanical systems, and medical device fields. He is equally adept at evaluating patents for validity and conducting non-infringement assessments, helping clients navigate dense landscapes of competitor patents. His strategic insights and sound counsel have repeatedly earned the trust of clients facing high-stakes, bet-the-company decisions in competitive, innovation-driven markets.

In addition to client counseling, Justin is also an active PTAB litigator, having represented both petitioners and patent owners in dozens of PTAB proceedings. His outstanding record has set him apart as one of the most effective PTAB advocates in the country. Justin also handles district court and ITC litigation and patent prosecution matters across a range of technical fields. He currently chairs the Colorado Section of American Chemical Society (ACS) and is a past Chair of the ACS Committee on Intellectual Property.

Justin teaches courses on PTAB litigation as an adjunct professor at the University of Denver Sturm College of Law and the Mitchell Hamline School of Law. He also lectures and publishes frequently on various intellectual property topics including PTAB litigation, trade secrets, the America Invents Act, and the “on sale” bar to patentability.

Justin’s work has earned him repeated recognition: Law Week Colorado named him Barrister’s Best IP Litigator in 2021, 2024 and 2026, Managing IP labeled him an “IP Star” and nominated him for PTAB Practitioner of the Year in 2025, and he is ranked by Chambers USA, LawDragon 500, and IAM 1000 – The World's Leading Patent Practitioners. Justin was also recognized in 2024, 2025 and 2026 by The Best Lawyers in America® for Patent Law and was individually recommended for PTAB litigation by IAM 1000 and for Patent Prosecution by Legal 500 US in 2018, 2020, 2021, 2024 and 2025.

While attending law school, Justin was a member of the Florida Law Review.

Experience

Justin supervises a post-grant patent practice team that has consistently obtained favorable results for the firm’s clients. He has served as lead counsel in dozens IPR and PGR proceedings, representing clients both as petitioner and patent owner. Justin has repeatedly beaten the odds and boasts a win rate far exceeding national averages.

Justin also actively prepares non-infringement and validity opinions including comprehensive freedom-to-operate (FTO) analyses in the chemical, polymer, medical device, and mechanical arts from both due diligence and litigation perspectives. Justin also has been actively involved in numerous patent litigation matters and has participated in all phases of discovery, claim construction (Markman hearings), trial, and appeals. He is also experienced in Section 337 investigations before the U.S. International Trade Commission (ITC).

Justin also leads a nationally recognized patent prosecution team for clients in the fields of industrial chemistry and chemical engineering, pharmaceuticals, agrochemicals, medical devices and analytical instruments.
