The ITC has become an increasingly important venue for patent infringement lawsuits, though it is crucial to be mindful that it is not a traditional (Article III) court (a “Federal Court”). Instead, the ITC is an administrative agency and as such it operates differently than Federal Courts. One particularly notable difference is that the ITC’s subpoena powers are more limited than those of Federal Courts.
