One of the central issues in most AIA post grant proceedings is claim construction. It goes directly to whether the claims at issue read on the prior art and ultimately on whether those claims are valid or invalid. Justin Krieger begins his panel discussion with the general rules of claim construction and then he highlights a few recent Federal Circuit decisions that will help us to better understand what is meant by Broadest Reasonable Interpretation standard, which is the claim interpretation standard used in post grant PTAB proceedings. Justin will also discuss various procedural pitfalls to avoid when briefing up a claim construction argument.
