The America Invents Act (AIA) “On-Sale bar” to patentability is similar in many respects to its pre-AIA predecessor. But there are many important distinctions as well. This session will provide an update on developments concerning the on-sale bar, address some of the changes to the statute, as well as recent case law on this important topic. Learn practice tips on how best to avoid and overcome potential issues involving the on-sale bar, including patentability issues that may arise during prosecution and validity issues that may be encountered in litigation or in Post Grant Review (PGR) proceedings.
